Federal Requirements

OIG Exclusion List

Required for all employees of agencies billing Medicare/Medicaid. Check before hire and monthly thereafter at oig.hhs.gov.

SAM Database

Check sam.gov for debarment and exclusions from federal programs.

Nurse Aide Registry

Verify active certification and check for findings of abuse, neglect, or misappropriation.

State-Level Components

Criminal History

Most states require state criminal records, FBI fingerprint check, and sometimes county-level searches.

Common Disqualifying Offenses

Murder, sexual offenses, assault, theft/fraud from vulnerable adults, drug offenses, healthcare fraud, abuse/neglect/exploitation. Each state defines its own list and look-back periods.

Look-Back Periods

  • Some offenses: Permanent disqualification
  • Others: 5-10 year period
  • Minor offenses: May not disqualify

  • Adult Abuse Registry β€” State protective services records
  • Child Abuse Registry β€” Required where caregivers may contact minors

Fingerprinting

Many states including California, Florida, New York, and Illinois require fingerprint-based checks. The process uses LiveScan electronic capture. State results in 1-5 days; FBI in 2-4 weeks.

Drug Testing

Requirements vary: some states mandate it, many agencies require it regardless. Common panels: 5-panel or 10-panel. Pre-employment and random testing may both apply.
